PLACING AN ORDER
Orders are placed directly through our website. Once you have selected your items and added them to your basket, you’ll be guided through the checkout process where you’ll be asked to provide your contact, delivery and payment details. Before finalising your purchase, please ensure all order information, including products, sizes and delivery address, has been reviewed carefully prior to submitting payment.
Placing an order through our website constitutes an offer to purchase the items in your basket. Once your order has been submitted, you will receive an email confirming that we have received it. A binding contract between you and Resilient Bodybuilding will only be formed once we email you to confirm that your order has been dispatched. This dispatch confirmation will include your order reference number, which should be quoted in any correspondence regarding your order.
To place an order with us, you must be at least 18 years of age and have permission to use the payment method provided. We do not knowingly sell to individuals under the age of 18.
RETURNS & REFUNDS
Items purchased directly from our website may be returned in their original, unused condition with all tags attached. Returns showing signs of wear, washing, damage or alteration will not be accepted and will be returned back to you.
Customers have 30 days from the date of delivery to return their item. All returns are inspected. Any items that do not meet our return requirements policy will not be accepted for a refund and we reserve the right to refuse.
Customers are responsible for the cost of returning items. For UK customers, we offer a prepaid Royal Mail return label or QR code. If this is used, the cost of the return label will be deducted from your refund, in line with our returns policy. International customers are responsible for arranging and covering the cost of return shipping, using a courier of their choice. We do not currently provide prepaid return labels for international orders. For full details on returns, refunds and exchanges, please refer to our Returns and Refunds Policy.
OUR RIGHTS TO CANCEL THE CONTRACT
If we are unable to process or fulfil your order for any reason including stock availability, verification issues with payment or billing details, delivery restrictions, or errors in product information or pricing, we will notify you by email and no charge will be applied for the affected items.
Our products are sold for personal use only. We reserve the right to cancel or refuse orders if we believe items are being purchased for commercial, business, or resale purposes. If your order is affected and you believe this has been done in error, please contact us.
We may temporarily suspend the availability of a product in order to address technical issues or carry out minor technical updates, make updates required to comply with applicable laws or regulatory standards and/ or implement changes to the product that we have notified you about.
OUR RIGHTS TO END THE ORDER
We may cancel an order at any time by emailing you, if you fail to provide information required to fulfil your order, such as a delivery address, or if you do not allow delivery to take place within a reasonable timeframe. If we cancel your order, you will receive a refund for anything you have paid for but not received.
FAULTY GOODS & STATUTORY RIGHTS
Under UK consumer law, you are entitled to receive goods that are as described, of satisfactory quality and fit for purpose.
If any product you receive is faulty, damaged, or not as described, you have the following statutory rights:
* Within 30 days of receiving your item, you are entitled to a full refund if the item is faulty.
* After 30 days and up to 6 months from delivery, you are entitled to a repair or replacement. If a repair or replacement is not possible or is unsuccessful, you may be entitled to a refund.
* After 6 months, you may still be entitled to a repair, replacement, or partial refund, depending on the circumstances.
* Where a refund is due for faulty goods, it will be issued using the original payment method. We will also cover reasonable return shipping costs for faulty items.
These rights apply in addition to and do not affect, your rights under our voluntary 30 day returns policy.
Nothing in these Terms and Conditions limits or excludes your statutory rights under the Consumer Rights Act 2015.
YOUR RIGHTS TO CANCEL THE CONTRACT
You may cancel your order at any time. Your rights will depend on the product purchased, whether it is faulty and when you choose to cancel. We are legally required to supply products that meet the terms of your order and nothing in these Terms and Conditions affects your statutory consumer rights.
If a product is faulty, significantly different from its description, or incorrect, you may be entitled to a refund or replacement in accordance with UK consumer law.
If you choose to cancel your order for reasons such as a pricing error, a change to the product or these terms that you do not agree to, a significant delay, or an issue caused by us, we will refund any payments made for items not yet supplied.
You have a legal right to cancel your order within 14 days of receiving your items, even if you change your mind. Our 30 day returns period, from the date you receive your order and subject to our Returns Policy, is offered in addition to and does not affect, your statutory rights under UK consumer law.
In all other cases, you may still cancel an order before it has been dispatched by contacting us.
OUR PRODUCTS
We provide gym apparel, including clothing and accessories. Product images and packaging shown on our website are for illustrative purposes only. While we aim to display colours as accurately as possible, we cannot guarantee that the colours shown on your device will precisely match the actual product.
SHIPPING & DELIVERY
We deliver to selected destinations only. Full details of available delivery methods, estimated delivery times and the countries we ship to are set out on our Shipping and Delivery page.
Delivery timeframes are estimates and may vary due to factors outside our control, including courier delays and customs processing.
We are not responsible for delays or failure to perform our obligations where this is caused by events beyond our reasonable control, including but not limited to courier disruptions, strikes, severe weather, or acts of government.
Once your order has been delivered and marked as delivered by the courier, responsibility for the item passes to you. We are not responsible for parcels that are lost or stolen after delivery.
CUSTOMS, DUTIES & IMPORT TAXES
International orders may be subject to customs duties, import taxes, or additional fees imposed by the destination country. These charges are set by local authorities. They are not included in our product prices or shipping costs and are the responsibility of the customer. Any applicable charges may be requested by the courier or customs authority prior to delivery.
PRICING & PAYMENT
All prices displayed on our website are shown in GBP (£). Payment is taken using the methods available at checkout and the price charged will be the one shown at the time your order is placed.
DISCOUNT CODES
From time to time, we may offer discount codes through email or other marketing channels. Codes must be entered at checkout to be applied and are valid only for the period stated in the relevant promotion.
Only one discount code can be used per order. If you return an item, your refund will reflect the price you paid after any discount. If your order qualified for a promotion (such as a minimum spend), returning items may affect your discount and your refund may be adjusted. This does not affect your statutory rights.
We reserve the right to refuse, withdraw, amend, or cancel discount codes or orders where we believe a code has been used incorrectly, fraudulently, or outside its intended terms.
OUR RESPONSIBILITY FOR LOSS OR DAMAGE
We are responsible for any foreseeable loss or damage caused by our failure to use reasonable care and skill, or to comply with these Terms and Conditions. We are not responsible for losses that are not reasonably foreseeable. Nothing in these Terms and Conditions limits or excludes liability where it would be unlawful to do so, including liability for death or personal injury caused by negligence, fraud, or breach of your statutory rights. Our products are supplied for personal use only. We are not liable for any business related losses, including loss of profits, business interruption, or loss of opportunity.
FLAGGED SHIPPING & RETURNS
We monitor returns activity to help prevent misuse of our Shipping and Returns policies. Where we identify unusual or excessive return behaviour, we may review the associated account and where appropriate, restrict or refuse future returns. We reserve the right to refuse service where we believe our policies are being abused.
COMPLAINTS
If you have a complaint or concern relating to your order or our services, please contact us.
GOVERNING LAW
These Terms and Conditions are governed by the laws of England and Wales and any disputes arising in connection with them shall be subject to the exclusive jurisdiction of the courts of England and Wales.
